2C-6 Enact Gender Equality Act

By: Rusni Tajari

Organisation/ Individual: Women’s Aid Organisation (WAO)

Policy Code: 2c Women

Problem Statement and Current Policy:

The Gender Equality Law has not been enacted although the CEDAW Committee’s Concluding observations recommended this in 2006. It has been stalled since the PN govt came into power although work on it had started in 2019

Value(s) and Belief:

The gender equality guarantee in article 8 of the Constitution is not enough to enable the achievement of equality or to bring about de facto equality as required under CEDAW.

Proposal of Solution and Call for Action:

Set timeline to finalise and enact the Gender Equality Act.

Additional information:

JAG has been advocating for a GE act since 2009 The enactment of the GE law will help operationalise the equality guarantee in the Constitution. The GE act will be a form of domesticating CEDAW and will help to fulfill obligations under CEDAW and to be accountable to women in the country Further readings; “Main elements of JAG’s proposed Gender Equality Act for Malaysia.” Link: https://wao.org.my/wp-content/uploads/2018/11/JAG-Policy-Brief-May-2017-Main-Elements-of-GEA.pdf
